Video Released of Alleged Assault by Tina Peters in Colorado Prison – No Charges Announced as Investigation is Ongoing

Yesterday, former Mesa County Clerk Tina Peters’ X account released a statement that alleged she had been attacked and defended herself in La Vista prison while moving a water unit into a closet. According to the statement, Peters was told that she would be charged with felony assault and “locked down completely for 24-72 hours.”
According to a statement emailed to Denver 7 from the prison, “La Vista Correctional Facility does not utilize solitary confinement. Conducting an investigation and moving one or more of the involved inmates to different housing areas pending the investigation is standard safety and security procedures for any incarcerated person involved in an incident, pending investigation results.”
The statement also said they could not confirm any additional charges as the internal investigation is being conducted.
Released security camera footage showed the end of the altercation but had no visibility of what took place inside the closet.
In the video, Peters can be seen wheeling a large object into a closet with two other inmates visible but censored in the foreground and a few others walking around.
As Peters backed into the closet wheeling the object inside, another inmate approaches the right side of the closet opening holding what appears to be a spray bottle. That inmate is allegedly 20 year old, significantly younger than the 70 years old Peters.
That inmate reaches into the closet with the view blocked by door the door. The object is moved out of the way and Peters is seen immediately moving towards the inmate holding that inmate’s right arm that reached inside the closet and her neck.
Peters drives the inmate back and releases her. A man in a white shirt, shorts, and sandals intervenes and the parties go their separate ways.

In Colorado, felony assault (CRS 183-3-202) requires “serious bodily injury to any person by means of a deadly weapon,” “intent to disfigure another person seriously and permanently” or other “with the intent to cause serious bodily injury, she applies sufficient pressure to impede or restrict breathing or circulation of the blood…by applying pressure to the neck or by blocking the nose or mouth…thereby causing serious bodily injury.“
Even CRS 18-3-204, Assault in the third degree, a misdemeanor, requires “bodily injury.” Even if Peters was not assaulted in the closet, which she claims she was, there was no apparent serious bodily injury following the altercation.
